License, Terms of Use, and Policies

The Vibroacoustic Session Designer ("the App") and its user manual are products of Our Minds Change LLC ("we," "our," "us"). By purchasing access to the App, using it on our website, or downloading a copy, you agree to these terms, which operate alongside the Terms of Service and Privacy Policy of ourmindschange.com. Where these terms address the App specifically, they apply; for everything else, our site policies govern.

1. Your License
Your purchase grants you a personal, non-transferable, lifetime license to use the App and its manual for your own sessions, your own practice, and your own creations, on any devices you personally use. This license includes all future updates to the App at no additional cost. Access for additional practitioners, staff, or locations requires additional memberships.

2. What You Create Is Yours
Everything you make with the App, including rendered audio sessions, enhanced mixes of your own music, journey designs, and frequency banks, belongs entirely to you. You may use, share, perform, and sell your creations freely, including in professional practice, subject to your own responsibility for the rights to any music you bring into it.

3. What Remains Ours
The App, the manual, our presets, our signature journey designs sold separately, and the Our Minds Change name, logo, and branding are the intellectual property of Our Minds Change LLC and are protected by applicable copyright and trademark law. You agree not to redistribute, resell, publicly post, sublicense, or offer the App or manual files themselves to others, and not to remove the attribution and notices they contain. Sharing what you create with the App is encouraged; sharing the App itself is what memberships are for. Purchased journey design files are licensed for your personal use on the same basis.

4. All Sales Are Final
Because the App and manual are digital goods delivered instantly and downloadable for permanent offline use, all purchases are final and non-refundable, consistent with the digital goods policy in our Terms of Service. Please review the product description, and reach out with any questions before purchasing; we would rather answer ten questions than sell one membership that isn't right for you.

5. Wellness Disclaimer
The App creates audio for relaxation and wellness. It does not diagnose, treat, cure, or prevent any condition, and it is not a substitute for professional medical advice, diagnosis, or treatment. Presets and frequency palettes drawn from spiritual traditions are offered as tradition, not as clinical claims. Always keep vibration and volume at comfortable levels, begin gently with any new creation, and honor immediately any listener's request to lower intensity or stop. If you are pregnant or have a pacemaker or other implanted device, a history of blood clots, recent surgery, or a seizure condition, consult a qualified healthcare provider before use, and advise anyone you share sessions with to do the same. You are solely responsible for how you use the App and for the wellbeing of those who experience your creations.

6. Privacy
The App itself collects nothing. It runs entirely in your browser, whether on our website or from your downloaded copy, and your audio, designs, renders, and frequency banks never leave your computer. The App stores no information about you anywhere and works fully offline. Your membership is managed through Squarespace, which collects your name, email, mailing address, and payment details at checkout on our behalf; this information, and our website's standard analytics, are handled as described in our Privacy Policy. We never sell your information, and we never see your card details.

7. Updates and Availability
This is a living tool. Improvements and new features are provided to members through the member page, and your downloaded copy may be refreshed there at any time. We intend to maintain member access indefinitely, but should the member page ever be discontinued, your downloaded copy and its license remain yours permanently, which is precisely why the download is included.

8. Third-Party Components
The App includes the lamejs MP3 encoder, an open-source component used under the LGPL license, embedded as a distinct and replaceable part of the App with attribution in the source. All other code is original to Our Minds Change LLC.

9. As-Is Provision and Limitation of Liability
The App and manual are provided as is and as available, with care but without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant uninterrupted or error-free operation on every device or browser. To the fullest extent permitted by law, the total liability of Our Minds Change LLC arising from or related to the App is limited to the amount you paid for access, and we are not liable for indirect, incidental, or consequential damages, consistent with our Terms of Service.

10. Termination
We may suspend or terminate member page access for violation of these terms, particularly redistribution of the App or manual. Sections 3, 5, 8, and 9 survive any termination.

11. Governing Law and Changes
These terms are governed by the laws of the State of Texas, USA, with disputes handled as described in our Terms of Service. We may update these terms from time to time; the current version will always be posted with its Last Updated date, and continued use of the member page after changes means you accept them.
